Hackathon judges have been selected to represent subject domain and technical expertise. The panel of judges will evaluate entries based on the following criteria.

 

Relevance (25 points): 

  • Apply SAP and Esri technologies together to broad extent
  • Compliance with the selected Challenge
  • Solution relevance to UN Sustainable Development Goals

 

Innovation (25 points): 

  • Use of unique approaches to solve a problem
  • Creativity in application design
  • Inclusion of AI or machine learning for example to predict outcomes or preventive problem solving

 

Entertainment Value (25 points): 

  • Does the presentation hook people in? 
  • Does it stand out compared to others? 
  • Does it tell a story that will stick?

 

Visual Experience (25 points): 

  • Does the solution have a compelling, intuitive UX? 
  • Does the solution have exceptional visual appeal?
  • Does it include analytics to visualize the result?

SAP Spatial Hackathon License and Participation Agreement

 

IMPORTANT-READ CAREFULLY: THIS SAP SPATIAL HACKATHON LICENSE AND PARTICIPATION AGREEMENT (“AGREEMENT”) IS A LEGAL AGREEMENT BETWEEN SAP AMERICA, INC. WITH OFFICES AT 3999 WEST CHESTER PIKE, NEWTOWN SQUARE, PENNSYLVANIA  19073(“SAP”) AND YOU (“YOU” OR “YOUR” OR “PARTICIPANT”) REGARDING PARTICIPATION IN THE SAP SPATIAL HACKATHON AND THE EVENT TECHNOLOGY AND SOFTWARE, AS WELL AS ANY THIRD PARTY TECHNOLOGY, MADE AVAILABLE TO YOU DURING THE EVENT. IF YOU DO NOT AGREE TO THE TERMS OF THIS AGREEMENT AND THE OFFICIAL RULES, WHICH ARE ATTACHED HERETO, YOU CAN NOT PARTICIPATE IN THE EVENT. 

 

Scope

SAP, in conjunction with Esri, Inc. (a “sponsor”)  is hosting the SAP Spatial Hackathon on March 5, 2018 at the ESRI Developers Summit in Palm Springs, California (the “Event”).  Participants at the Event will be asked to respond to design challenges posed by SAP at the Event (the “Purpose”).  

Pursuant to this Agreement, Participant is granted a license, during the Event, to develop, test, evaluate and demonstrate applications which are responsive to the challenges posed (an “Application(s)”) using application programing interfaces and software development kits, and cloud based solutions relating to the following SAP and third party technology:

and any other software/technology provided during the Event

(collectively the "Software" or the “Event Technology”). The Event Technology will be provided by SAP for temporary installation and/or use during the Event, or SAP may direct Participant to obtain the Event Technology by downloading or accessing an evaluation or trial license that is subject to a separate set of terms and conditions to which Participant will need to agree to access that Event Technology (“Trial Agreement”). SAP may also supply additional materials and documentation related to the Event Technology under this Agreement (hereinafter “Event Materials”).

 

License Rights and Intellectual Property

2.1    Subject to the terms and conditions of this Agreement and any Trial Agreement, SAP grants to Participant, during the Event, a non-transferable and non-exclusive, limited license to use the Event Technology for the exclusive purpose of developing, testing, evaluating, and demonstrating Applications on Participant supplied hardware and system(s) and in accordance with the Event Materials. If requested upon completion of the Event, Participant shall return to SAP or cease using any of the Event Materials, and Event Technology and Software provided by SAP pursuant to this Agreement that is not subject to a separate Trial Agreement. In the event Participant accesses or uses Event Technology that is subject to a separate license agreement, then with respect to the use of that Event Technology that license agreement shall control with the exception of rights that may be granted to use the Event Technology in connection with the Event.  

2.2 ANY APPLICATIONS DEVELOPED SOLELY BY PARTICIPANT SHALL BE OWNED BY PARTICIPANT (“APPLICATION”). Participant grants to SAP an irrevocable, royalty-free, worldwide right and license to: (i) use, review, assess, test, and otherwise analyze your Entry and all its content in connection with this Event; and (ii) feature your Entry and all its content in connection with the marketing, sale, or promotion of this Event and SAP and Event Technologies (including but not limited to press releases, promotional material, internal and external presentations, and tradeshows, in all media now known or later developed). You acknowledge that SAP and/or other entrants may have developed or or will develop applications similar to or identical to Your Entry, and You/Your team waive any claims you may have resulting from any similarities to your Entry. 

2.3 If for any reason any of the proprietary rights described in Section 2.2 of this Agreement directly accrue to any third party (e.g., an employer) whether involved or not involved in the developing, demonstrating, testing and evaluating, Participant shall ensure the grant of rights under Section 2.2 through appropriate undertakings with such third parties.

2.4 Participant shall not be entitled to license, sell, lease, rent, outsource or otherwise transfer or make available the Event Technology, Software, or the Event Materials to third parties.

2.5 Participant shall not be entitled to duplicate, translate, decompile, reverse-engineer or otherwise modify any parts of the Event Technology, Software, or the Event Materials.

2.6 Participant shall not remove notices and notations in the Software and the Event Materials that refer to copyrights, trademark rights, patent rights and other intellectual property rights.  Any and all patent rights, copyrights, trademark rights and other rights in the Event Technology and the Event Materials, as well as any improvements, inventions, design contributions or derivative works conceived or created by either party in or to the Event Technology or the Event Materials, shall remain the exclusive property of SAP and/or its licensors. Except for the limited license rights expressly granted herein, this Agreement does not transfer any proprietary right or interest in the Event Technology, Software or the Event Materials to Participant.  

 

No Services or Support Obligation

Under this Agreement neither SAP nor any other sponsor provides or is under any obligation to provide any technical support services for the Event Technology or Software. SAP and the sponsors may, in its sole discretion, provide Participant with guidance and instructions on the use of the Event Technology and Software, and Event Materials contemplated by this Agreement.

 

Limitation on Warranties and Liabilities 

THE EVENT TECHNOLOGY, SOFTWARE, AND  MATERIALS ARE LICENSED TO PARTICIPANT “AS IS”, WITHOUT ANY WARRANTY, ESCROW, TRAINING, MAINTENANCE, OR SERVICE OBLIGATIONS WHATSOEVER ON THE PART OF SAP OR ANY SPONSOR.  NEITHER SAP NOR ANY SPONSOR MAKES ANY EXPRESS OR IMPLIED WARRANTIES OF ANY TYPE WHATSOEVER, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY AND OF FITNESS FOR A PARTICULAR PURPOSE.  PARTICIPANT ASSUMES ALL RISKS ASSOCIATED WITH ITS USE OF THE EVENT TECHNOLOGY, SOFTWARE, OR MATERIALS, INCLUDING WITHOUT LIMITATION RISKS RELATING TO QUALITY, PERFORMANCE, DATA LOSS, AND UTILITY IN A PRODUCTION ENVIRONMENT.  IN NO EVENT SHALL SAP OR ANY SPONSOR BE LIABLE TO PARTICIPANT OR TO ANY THIRD PARTY FOR ANY DAMAGES ARISING IN CONNECTION WITH PARTICIPANT’S USE OF OR INABILITY TO USE THE EVENT TECHNOLOGY, SOFTWARE, AND EVENT MATERIALS IN CONNECTION WITH THE PROVISION OF OR FAILURE TO PROVIDE SERVICES PERTAINING TO EVENT TECHNOLOGY, SOFTWARE, AND MATERIALS, OR AS A RESULT OF ANY DEFECT IN THE EVENT TECHNOLOGY, SOFTWARE, OR  MATERIALS.  THIS DISCLAIMER OF LIABILITY SHALL APPLY REGARDLESS OF THE FORM OF ACTION THAT MAY BE BROUGHT AGAINST SAP OR ANY SPONSOR, WHETHER IN CONTRACT OR TORT, INCLUDING WITHOUT LIMITATION ANY ACTION FOR NEGLIGENCE.  PARTICIPANT’S SOLE REMEDY IN THE EVENT OF BREACH OF THIS AGRREEMENT BY SAP OR ANY SPONSOR OR FOR ANY OTHER CLAIM RELATED TO THE EVENT TECHNOLOGY, SOFTWARE, AND/OR  MATERIALS SHALL BE TERMINATION OF THIS AGREEMENT.

 

Confidentiality

 5.1 Participant shall treat as confidential all confidential information and trade secrets of SAP, sponsors, and their licensors acquired in connection with the performance of this Agreement that are expressly identified as confidential or proprietary or that are reasonably identifiable as confidential or proprietary based on the circumstances of their disclosure or by their nature ("Confidential Information") and to use such Confidential Information only to perform this Agreement. Confidential Information of SAP and sponsors shall include all of, but are not limited to the Event Technology, Software (in object and source code),  Materials, data, programming techniques and concepts, processing methods, system designs embedded in the Software, inventions, techniques, concepts, designs, flow charts, documentation, product specifications, application programming interface specifications, techniques and processes that relate to the Event Technology, Software or the  Materials, information on SAP Participants and business partners and information about deployed third-party software. 

5.2 The foregoing obligation shall not apply to the extent that Participant shows that the information (i) was public knowledge at the time it was disclosed and had not become public knowledge through an act or omission by Participant or Participant’s employee or agent in breach of contract, or (ii) was in the possession of or known to Participant before Participant received it,  or (iii) had been lawfully disclosed to Participant by another person entitled to do so, or (iv) had been independently developed by Participant without reference to Confidential Information.

5.3 Confidential Information may be provided to third parties only upon prior written consent SAP. These third parties must be subject to a written non-disclosure obligation. The term “third party“ as used this Section does not apply to employees and subcontractors of Participant whose proper performance under this Agreement reasonably requires access to such information and who have executed corresponding non-disclosure agreements.

5.4 Any information that You provides in connection with an Entry and participation with the Event will not be considered or treated as confidential by SAP, any sponsor, or any participant, and as a result, You should take whatever steps you think are necessary to prevent confidential or proprietary information from being provided to SAP or other entities involved in the administration or participation in this Event.  Similarly, you understand that SAP has no obligation to and will not restrict work assignments of representatives who have had access to your Entry, so by entering this Event, you agree that use of any information submitted in connection with this Event by SAP or any of its representatives or individuals involved in the administration of, or participation in this Event in the development or deployment of their products or services shall not create any liability for any third party participating in this Event. 

5.5 SAP and sponsors are free to use any Feedback for any purpose.  Participant grants to SAP and sponsors a non-exclusive, perpetual, irrevocable, worldwide, transferable, royalty-free license, with the right to sublicense through multiple tiers, under all relevant Participant intellectual property rights, to use, publish, and disclose such Feedback and to display, perform, copy, make, have made, use, sell, and otherwise dispose of SAP’s and sponsor’s and their  sublicensee’s products or services embodying Feedback in any manner and via any media chosen.  SAP and sponsors shall be entitled to use Feedback for any purpose without restriction or remuneration of any kind with respect to Participant and/or any of its affiliates or agents.  “Feedback” is input, comments, or suggestions regarding the possible creation, modification, correction, improvement or enhancement of Event Software, Event Materials, or other SAP or sponsor software or services.   

 

General

6.1 PARTICIPANT AGREES TO ABIDE BY ANY HACKATHON RULES FOR PARTICIPATION IN THE EVENT, INCLUDING THE OFFICIAL RULES ATTACHED HERETO. 

6.2 This Agreement constitutes the entire agreement between the parties with respect to the use of the Event Technology, Software and Materials, and participation in the Event and (except as expressly indicated herein) supersedes all prior understandings and agreements regarding its subject matter.  SAP may change the terms of this Agreement at any time. In order to continue using the Event Technology, Software and Materials, and participating in the Event, Participant must accept and agree to the new terms of this Agreement.  If Participant does not agree to the new terms, Participant’s use of the Event Technology, Software and Materials, and participation in the Event will be suspended or terminated by SAP. 

6.3 Participant may not assign or otherwise transfer any of its rights under this Agreement without SAP’s prior written consent.

6.4 If any provision of this Agreement proves to be invalid, this will not affect any other provision of this Agreement.

6.5 This Agreement shall be governed by and construed under the laws of the State of California without reference to its conflicts of law principles. Exclusive venue for all claims arising out of or in connection with this Agreement shall be the State and Federal courts located in the state of California. The United Nations Convention on Contracts for the International Sale of Goods shall not apply to this agreement.  The Uniform Computer Information Transactions Act as enacted shall not apply.

6.6 The waiver by either party of any of its rights hereunder shall not be construed as a waiver of any subsequent breach.

 

SAP SPATIAL HACKATHON

OFFICIAL HACKATHON RULES 

VOID WHERE PROHBITED OR RESTRICTED BY LAW.  PARTICIPATION IN THIS HACKATHON CONSTITUTES YOUR ACCEPTANCE OF THESE RULES.

Introduction.  The SAP Spatial Hackathon (the “Hackathon”) is a skill based contest that takes place during the Event where participants  will join a team and then use one or more SAP products to create a working prototype of a solution to a problem that SAP poses during the Hackathon.  

Term.  Eligible entrants must participate in the Hackathon in person at the Event from March 4th to March 6th  (the “Hackathon Period”).  

Team Participation Requirement.  The Hackathon is limited to a group composed of between three (3)  and five (5) eligible individuals (each group a “Team”).  Each member of the Team must individually meet the Eligibility Criteria described in Section 4, below.  If one of more Team member(s) is found to be ineligible, or unable to participate in and/or fully enjoy any prize awarded, SAP has the right, but not the obligation, to disqualify the entire Team or the individual Team member, at its discretion.  In the event the entire Team is disqualified, SAP may select as an alternative the Team with the next highest score.    

Eligibility Criteria.  Entrants must (i) be eighteen (18) years or older; (ii) be present at the Event during the Hackathon  and at the winner announcement; and (iii) be a member of a Team as described above in Section 3 (“Participant(s)”). Individuals who are employees, officers or directors of SAP or any sponsor, and their respective parents, subsidiaries, affiliates and advertising and promotion agencies (collectively, “Hackathon Entities”), and the immediate family members (spouses, domestic partners and parents, children and siblings and their spouses or domestic partners, regardless of where they live) or members of the same households (whether related or not) of such individuals are not eligible to win.  EMPLOYEES OF THE UNITED STATES GOVERNMENT, THE GOVERNMENT OF ANY U.S. STATE OR TERRITORY, OR ANY FOREIGN GOVERNMENT ARE EXCLUDED FROM PARTICIPATION.  SAP reserves the right to verify eligibility and to adjudicate on any dispute at any time.  The Hackathon is subject to all federal, state, and local laws and is void where prohibited.  Participants in the Hackathon agree to be bound by these Official Rules and the decisions of the SAP.  

If a Participant is an employee of a business entity or an academic institution, enrolled as a student, or representing his or her employer or academic institution in this Hackathon, it is the sole responsibility of the Participant to review, understand and abide by his or her employer’s or academic institution’s policies regarding eligibility to participate in the Hackathon. If a Participant is found to be in violation of his or her school’s or employer’s policies, then he or she will be disqualified from participating in the Hackathon and being awarded or retaining any prize. SAP disclaims any and all liability or responsibility for disputes arising between a student or employee and his or her school or employer (or other members of his/her team) related to the Hackathon.

An individual may not be a member of more than one Team.  Upon discovering that an individual has registered as a member of more than one Team, SAP has the right, but not the obligation, to disqualify one or more of the involved Teams, or to disqualify one or more of the involved Team members of one or more Teams.

How to Enter.  SAP will pose a problem before the Event. A Team must use one or more components of the Event Technology (at least one made available by SAP and at least one made available by ESRI in connection with the Event) to develop a working prototype solution to the problem during the Hackathon Period (an “Entry” or “Entries”).  LIMIT ONE (1) ENTRY PER TEAM.  Subsequent entries will be disqualified. 

Teams will be given an opportunity to present and demonstrate their Entries to a judging panel in an approximate six (6) minute window of time allotted to them.

All decisions by SAP are final and absolute and are not subject to inquiry or appeal.  Any expenses Participants incur during the submission process are their sole responsibility.

Entry Requirements.  Entries must 

Be created by your Team during the Hackathon at the Event; 

Not contain any code written before the Hackathon; however, prior work on non-code items such as design, logo, wireframes, idea validation, digital mockups and the like are permitted;   

Make use of one or more Event Technologies made available by SAP and one or more Event Technologies made available by ESRI.

Teams may optionally use additional materials provided at the Event.

Judging and Winner Notification.  Each Entry will be judged by SAP and/or a panel of judges selected by SAP (the “Judges”), which may include the audience of Participants.  During a window of time selected by SAP (the “Review Period”), Judges will review the Entries and any demonstration or presentation of each Entry, (which may include, at SAP’s discretion, a review of various aspects of the Entry, which may include source code) and select the winning team. 

Judges will evaluate Entries on the following criteria: 

Relevance (Is the Entry relevant to the market, industry, customers, etc.);

Innovation (To what degree is the Entry new and different and pushing the edge);

Entertainment (To what degree does the Entry capture the attention of the crowd, and stimulate its imagination and discussion); and

Visual (Does the Entry provide exceptional visual appeal and a superior user experience).

Each Judge will select (through a means selected by SAP in its sole and absolute discretion) the Entry that he/she fulfilled the above criteria.  Each of the criteria will be equally weighted.  In the event of a tie, the tie will be broker through a means selected by SAP in its sole and absolute discretion, which may, without limitation, include a re-vote involving just the Entries that were tied.  In the event a potential winning Team is disqualified for any reason, the Team that receives the next highest number of votes will be chosen as the potential winning Team.

 

Prize. 

There will be one (1) Grand Prize for the winning Entry, and each member of the Team responsible for the winning Entry will receive the following:

- ArcGIS for Developer annual subscription + Drone package;

- $2,000 in cash; and

- A Press package, which will include a highlight in an SAP public communication.

There will be two (2) Runner-up Prizes for the next two highest scoring Entries, and each member of a Team responsible for the Runner-up Entry will receive the following: 

- RFID package w/ Raspberry Pi;

- $1,000 in cash; and 

- A Press package, which will include a mention in an SAP public communication.

Odds of winning depend on the number of eligible Entries received. The Prize winners may be required as a condition of receiving the prize to provide the SAP with his or her social security number so that appropriate reports may be filed with the appropriate tax authorities.  In the event that, for reasons beyond their control and not related to the Participants, the SAP is unable to award the Prizes as described in these Official Hackathon Rules, SAP will substitute a Prize of a similar nature and similar  value at their sole discretion.  The Prizes are non-assignable and non-transferable.  The Prizes (other than cash prizes) are not redeemable for cash.  A winner is not a recipient of a Prize until he/she has been verified or notified as a winner by the SAP or judges. No substitution is permitted except if a prize or portion of a prize is unavailable, in which case a prize of similar  will be awarded at SAP’s sole discretion.  If a selected Prize winner is unable to accept the prize in its entirety, the selected Prize winner will forfeit the Prize, and the Prize will be awarded to an alternate winner.  All prize details are at SAP’s sole discretion.  

Entrants acknowledge that the SAP and all other businesses concerned with this Hackathon and their agents do not make, nor are in any manner responsible for, any warranty, representations, expressed or implied, in fact or in law, relative to the quality, conditions, fitness or merchantability of any aspect of the Prize except that the prize shall be subject to manufacturer’s/provider’s standard warranty.

At least one (1) representative from the Team that submitted the winning Entry must be present at the time of the announcement to claim the Team’s Prize.  If a representative from a winning Team is not present at the time of the announcement of the winner, or if a Winner cannot accept or receive a Prize for any reason, or any non-compliance with these Official Rules, the Prize will be forfeited and awarded to the Entry with the next highest score. If not all Team members are present when a winning Entry is announced, it is the responsibility of the Team representative(s) to notify the other members of the Team.  

Taxes.  All federal, state, and local taxes, as well as any other costs and expenses associated with acceptance and use of the Prize are the responsibility of the  winning Team and each of its individual Team members.

Intellectual Property Rights.  Each Participant shall retain ownership of all intellectual property rights in each Eligible Entry (including moral rights) subject to the License and Participation Agreement, including these Official Rules.    

Participant Representations and Warranties.  By entering the Hackathon, Participants represent and warrant that their Entries (or such components that they contribute to a team’s Entry) are their own original work and, as such, they are the sole and exclusive owner and rights holder of the submitted entry and that they have the right to submit the Entry in the Hackathon and grant all required licenses and assignments.  Each Participant agrees that any outside data, tools, materials, or information used, were used with permission, or in accordance with all applicable laws for the purpose of entering the Hackathon.  Each Participant agrees not to submit any entry that infringes any third party proprietary rights, intellectual property rights, industrial property rights, personal or moral rights or any other rights, including without limitation, copyright, trademark, patent, trade secret, privacy, publicity, confidentiality obligations.  Participants also represent and warrant that they have not previously submitted their Eligible Entry as an entry in another Hackathon, promotion, competition, or similar activity except that Participants may submit an entry into multiple SAP-managed Hackathons.

Indemnity.  To the maximum extent permitted by law, each Participant indemnifies Hackathon Entities at all times from and against any and all liability, claims, demands, losses, damages, costs and expenses resulting from any act, default or omission of the Participant and/or a breach of any warranty set forth herein.  To the maximum extent permitted by law, each Participant agrees to defend, indemnify and hold harmless SAP and other entities responsible for the administration of this Event and their respective affiliates from and against any and all claims, actions, suits or proceedings, as well as any and all losses, liabilities, damages, costs and expenses (including reasonable attorneys’ fees) arising out of or accruing from (i) any entry or other material submitted by the Participant that infringes any copyright, trademark, trade secret, trade dress, patent or other intellectual property right of any person; (ii) any misrepresentation made by the Participant in connection with the Hackathon; or (iii) any non-compliance by the Participant with these Official Rules. 

Release, Publicity, and General Terms.  By participating in the Hackathon, Participants: (i) agree, to the fullest extent of the law, to release and hold harmless Hackathon Entities, and their respective parents, subsidiaries, affiliates, directors, officers, employees, and agents from any and all liability for any injuries, loss or damage of any kind arising from or in connection with the Hackathon, and (ii) grant to SAP and sponsors the right to use and publish their proper name and state or province and/or country, statements, photograph, voice and/or likeness for any advertising and promotional purposes relating to the Hackathon, in any media now known or hereafter devised, without further notice, compensation, consideration, review or consent and without regard to moral rights, except where prohibited by law.  Participants may be photographed and/or videotaped while at the Event and participating in the Hackathon. Participants agree that SAP and sponsor may use any photographs or videos obtained in this manner for promotional purposes, during or after the Event, in any media.

SAP assumes no responsibility or liability for the following: (i) telephone or technical malfunctions that may occur; (ii) any incorrect or inaccurate information, any of the equipment or programming associated with or utilized in the Hackathon, or any technical or human error which may occur in connection with the Hackathon; or (iii) any injury or damage to participants related to or resulting from participating in the Hackathon.  If, for any reason, the Hackathon is not capable of running as planned, including because of, tampering, unauthorized intervention, fraud, technical failures, force majeure, or any other cause beyond the control of SAP which may corrupt or affect the administration, security, fairness, integrity or proper conduct of the Hackathon, SAP reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Hackathon.  SAP reserves the right to change these Official Rules at any time, with or without notice.

Privacy.  Participant agrees that personal data entered during the registration and otherwise in connection with the Hackathon may be processed, stored, and otherwise used for the purposes and within the context of the Hackathon and as permitted by and in accordance with the SAP’s Privacy Policy found at http://global.sap.com/corporate-en/legal/privacy.epx. 

Governing Law.  These Official Rules are governed and interpreted by the laws of the State of California without regard to its conflict of law provisions.
